MINUTES OF MEETING

JANUARY 4, 1996


PRESENT:   CHAIRMAN FRED FENTON, JEFF ANDREWS, STEPHEN MACCLEERY, DOUG HAMEL, RON LESIEUR, PAUL ADAMS, STANLEY BREHM,SECRETARY ANDREA DEACHMAN

Chairman Fenton called the meeting to order at 7:04pm and requested the Board review the minutes from December 7, 1995.

Page 3:  Change Steve Davis Preliminary Hearing to read: Motion was made to accept the change of use on the Home Occupation Permit to read Bed & Breakfast/Craft Shop.

Page 2:  Change of wording New Zoning: F. Home Occupation: New Wording #1 Home Occupation will be allowed in Residential, Rural agricultural and conservation-openspace steep lands.

Motion was made to accept the minutes as corrected.

GENERAL PROVISIONS:


A. REBUILDING AFTER FIRE:

READS:



No owner or occupant of land shall permit fire ruins to be left.  The owner, within one year of the fire shall remove, rebuild or replace the structure, unless the insurance adjuster requires, in writing, an extension beyond a year.

NEW WORDING:

F. HOME OCCUPATION:

READS:

        1.   The home occupation shall be carried on by a member of the family residing in            the dwelling unit only.  Two employees who are not part of the family are                       permitted.

        2.   The primary activities of a home occupation shall be carried on wholly within                    the principal or accessory structure.

        3.   No home occupation shall be permitted which constitutes a nuisance or                           obnoxious use as determined by the Planning Board.

        4.   A home occupation permit may be issued following a public hearing.

NEW WORDING:

A member of the Board requested a few minor wording changes.

Motion was made to accept the wording changes.

Discussion about yard sales was on the Board members minds again this year.

Motion was made to drop the yard sale issue for another year.

                                                Lot Line Adjustment


Mr. Newhook presented the Board with a mylar of the Lot Line Adjustment
after some discussion the Board accepted the Lot Line Adjustment with request of signature box for the Chairman to sign and a map for the tax map.

Motion was made to accept the lot line adjustment with the understanding of the requested  information needs to be issued to the Board.

Mr. Dennison was not present for his site review again.


DISCUSSION:                             Nick Kourtis/Gerard Provencher
                                                Map 3, Lot 59
                                                Dover Road
                                                Site Review - Auto Sales

Attorney Gloria Schroud was present along with Mr. Nick Kourtis and Mr. Tim Stone.  Ms. Schroud explained to the Board that her clients needed to operate this business as soon as possible and could we in any way allow the business to start now while the site review process was on going.  The Board explained the reason for a site review and that they must proceed with the process and until the Public Hearing if the Board approved the site review at the Public Hearing then the business could open.

A Board member also suggested that they talk to Environmental Services on proper septic and disposal of oil etc.

The Board was in agreement that we need to hold a Preliminary and a Public Hearing.

The Board will write a letter to Mr. Kourtis stating they have started the Site Review process and February 1, 1996 will be the Preliminary Hearing.

The Board also reviewed the Site Review Checklist and  #5 can be back 50 feet from developed area.  #28 Negotiable and # 29 not applicable.

The Board also requested that a guarantee bond for pavement must be presented no later than the Public Hearing.

Preliminary Hearing will be set for February 1, 1996.

DISCUSSION:                             MASTER PLAN


All Board members present now have a copy of the 1986 Master Plan, all members will review the plan and suggestions on most important topic to start working on in February.
